Order and Delivery Terms – Realisointihuutokauppa.fi

These order and delivery terms apply to auctions conducted through the Realisointihuutokauppa.fi online service and to related orders. The site hosts several different business vendors who sell items in auction format. Realisointihuutokauppa.fi acts as a technical platform and not as the seller, unless otherwise stated.
Vendor
Realisointihuutokauppa.fi operates as the administrator of the online auction and is not the seller of the assets offered in the auction. The seller is the bankruptcy estate specified in each case, which is not considered a trader as defined in Chapter 1, Section 5 of the Consumer Protection Act.
“In this Act, a trader means a natural person or a private or public legal entity that professionally offers consumer goods for payment in order to obtain income or other economic benefit.”
Therefore, the provisions of the Consumer Protection Act concerning consumer sales do not apply to auctions conducted on the Realisointihuutokauppa.fi site.
Inspection and Viewing
The vendor will announce any viewing of the items for sale and the schedule separately in the main listing. Viewing may be arranged on more than one occasion if necessary.
Bidder’s Obligation
It is the bidder’s responsibility to inspect the items for sale in the extent they consider necessary in advance. By participating in the auction, the bidder declares that they are aware of the condition of the item.
The bidder is also responsible for providing accurate and truthful information when placing a bid. Bids submitted with false information will not be accepted, and the right to use the service may be denied.
Who Is the Buyer
The person who has made the highest accepted bid is considered the buyer.
Value-Added Tax
The value-added tax for the item is zero. The purchase price does not include deductible VAT. In cases where VAT must be paid on top of the bid price, this will be stated separately in the listing (for example, in corporate restructuring liquidations).
Auction Method
The auction is conducted with incremental bids. The minimum allowed increment is stated for each item.
AUCTION TYPE 1
The auction has a set closing time. If a bid is placed during the last three (3) minutes before closing, the closing time will be extended so that there are always three (3) minutes remaining after the last bid. After this, the vendor has the option to accept or reject the winning bid. Items may close on any day of the week.
Extension Period
A five-minute extension allows bidding to continue as long as bidders are willing to place higher bids.
AUCTION TYPE 2
The auction has a closing rule. If no new bid is placed on the item during the current day, the auctioneer may accept the highest bid at any time. The closing may be delayed when:
- Sales procedure – The time between the last bid and closing is considered too short. The purpose is to allow a reasonable time for bidders to react to the latest and currently highest bid.
- Final conditions – The vendor has set conditions for accepting the sale. These may include resolving disputes, adding information or images, or correcting errors in the listing.
Extension Period
A one-day extension for the auction closing allows bidding to continue as long as bidders are willing to place higher bids. After closing, the vendor may accept or reject the winning bid. However, items are not closed on weekends (Saturday–Sunday).
Start of the Sales Period
The sale begins when the items appear on the website.
End of the Sales Period
The vendor may sell the item at any time. The buyer is the person with the latest bid at the moment the vendor declares the item sold.
Removal of the Item from Sale
The vendor may decide not to sell the item. The vendor has the right to remove the item from sale at any time, in which case no transaction between the buyer and the vendor has taken place.
Purchase Price and Payment
The buyer must pay the purchase price in full to the account specified by the vendor within three days. In certain cases, the vendor also has the right to require immediate payment.
Deviation from Payment Terms
The vendor may, at their discretion and on a case-by-case basis, accept a deposit or grant a payment extension.
Collection of the Item
The buyer must collect the item at the time specified in the listing or in the collection instructions sent after the bid has been accepted, unless another time has been agreed with the vendor. However, the buyer is not entitled to collect the item if the purchase price has not been paid.
Failure to Pay the Purchase Price
If the buyer fails to pay for the purchased item as described above, the buyer is responsible for compensating the vendor for any damages and costs incurred.
Condition of the Goods, Vendor’s Liability, and Limitations of Liability
The goods are sold as-is.
The vendor or Realisointihuutokauppa.fi is not responsible for the condition of the goods and provides no warranty of any kind. They are not liable for any defects or damage, whether caused by previous storage, handling, use, wear, modifications, repairs, or any other reason.
The vendor or Realisointihuutokauppa.fi is not liable for indirect or consequential damages caused to the buyer or any other party due to delays, defects, shortages, or other reasons.
The vendor or Realisointihuutokauppa.fi is not liable for direct or indirect damages to the buyer or any other party caused by the cancellation of the listing or sale, termination of the transaction, or incomplete or incorrect listing information.
The vendor’s or Realisointihuutokauppa.fi’s liability for other direct damages is limited to a maximum of €400.00. No liability exists for damages caused by minor negligence.
Vendor’s Liability for Vehicle Taxes
The vendor is not responsible for any outstanding vehicle taxes, fuel taxes, or other charges related to vehicles.
